Synth Cabal — Terms of Service

1. Who we are
Synth Cabal ("Synth Cabal", "we", "us") is operated by Individual Entrepreneur Nikita Babenko Vladimir, registered in the Republic of Armenia (the "Operator"). The Operator is the same legal entity behind VibeNest and is the controller of personal data processed through Synth Cabal.

2. What Synth Cabal is
"Synth Cabal" is the collective name for:
- the Telegram bot @SynthCabalBot;
- the Telegram Mini App served inside Telegram (the "TMA");
- the companion web dashboard served at Synth Cabal's public URLs (the "Web App").
Together these three surfaces form the "Service". The Service helps users describe a software project in natural language, plan it with AI assistants, and deploy it — optionally — to the VibeNest hosting platform.
Synth Cabal runs on top of third-party services (Telegram, OpenRouter, model providers, GitHub, VibeNest). You remain bound by those providers' own terms when you use features that rely on them.
3. Who can use Synth Cabal
- You must be at least 13 years old, and at least 16 years old if you live in the European Economic Area (EEA) or the United Kingdom.
- You must have a valid Telegram account and comply with Telegram's Terms of Service and Bot Platform Terms.
- By sending your first message, tapping through the TMA, or opening the Web App, you confirm that you have read and accept these Terms and our Privacy Policy.
If you use Synth Cabal on behalf of an organisation, you confirm you have authority to bind it.
4. Your account and content
Synth Cabal identifies you by your Telegram account. You are responsible for:
- the projects, prompts, code, environment variables, API keys and other credentials you supply;
- the commands and actions you trigger through the bot, the TMA, or the Web App;
- keeping your Telegram account, recovery methods, and any linked GitHub or VibeNest accounts secure.
You retain ownership of the prompts you write and the code generated for you by AI. You grant Synth Cabal a worldwide, non-exclusive, royalty-free licence to process that content solely to operate the Service (for example: forwarding prompts to language-model providers, storing generated code in your Git repository, shipping artefacts to VibeNest on your request).
5. Acceptable use
You agree not to use Synth Cabal to:
- do anything illegal under the laws of Armenia, your country of residence, or a country where the Service is accessed;
- generate or distribute malware, spyware, phishing kits, credential stealers, or other material designed to harm people or systems;
- build products or datasets aimed at scraping Telegram, evading Telegram safety features, or training machine-learning models on Telegram content;
- harass, threaten, defame, or sexualise minors;
- infringe anyone's intellectual-property, privacy, or publicity rights;
- interfere with the Service, attempt to break authentication, bypass rate limits, or reverse-engineer the platform except as permitted by applicable law.
We can suspend or terminate access, remove content, or block projects that breach this section, with or without notice, at our reasonable discretion.
6. AI-generated content
Synth Cabal orchestrates third-party large-language-model providers (see the Privacy Policy for the current list). The output of those models:
- is produced automatically, without human review;
- may be incomplete, incorrect, biased, insecure, or offensive;
- must be reviewed and tested by you before any production use;
- is provided without warranty of any kind, to the maximum extent permitted by law.
You are responsible for the code, configuration and infrastructure Synth Cabal generates on your behalf, including its security, licensing compliance, and fitness for purpose.
7. Telegram Stars, tokens and billing
Synth Cabal sells a virtual currency called tokens, used to pay for AI operations performed by the Service.
- Tokens are purchased in packages using Telegram Stars (XTR) through the TMA. They are a licence to consume AI compute inside Synth Cabal and are not money, cryptocurrency, or a stored-value instrument.
- Package pricing is shown on the
/topuppage at the moment of purchase and includes a platform fee that covers model costs, infrastructure and margin. - First-time top-ups may receive a bonus (currently +20%); the bonus amount is shown in the TMA before you confirm the purchase.
- Telegram Stars can be refunded while the tokens credited by the corresponding top-up have not yet been spent. Synth Cabal does not exchange Stars for fiat directly — refunds are processed through Telegram's
refundStarPaymentmechanism. See section 8 for how to request one. - Consumed tokens are non-refundable. Unused tokens remain in your wallet until used or until your account is closed.
- We may change token prices, package sizes, and bonus rules at any time; changes apply only to purchases made after the update.
8. Refunds and payment support
You can reach payment support by:
- sending
/paysupportto @SynthCabalBot, or - emailing [email protected].
We will investigate and, where appropriate, issue a full or partial Telegram Stars refund using Telegram's refundStarPayment mechanism. Typical grounds for a refund: the Service failed to deliver the tokens corresponding to a paid invoice, a clear pricing error, or a legal obligation.
Refunds are at our reasonable discretion. Where tokens have already been consumed in AI operations, we may deduct those tokens from the refunded amount. After a refund, the corresponding tokens are removed from your wallet.
9. VibeNest and other integrations
When you ask Synth Cabal to deploy a project, create a test preview, or link a hosting account, Synth Cabal communicates with VibeNest (operated by the same Operator). In that case the VibeNest Terms of Service and Privacy Policy also apply to the deployment.
Similar rules apply when you link GitHub, connect credentials, or opt into other third-party integrations. You are responsible for reading and accepting those providers' terms.
10. Availability, changes and termination
- We aim to keep Synth Cabal available but do not guarantee any specific uptime. We may change, suspend, or shut down features at any time, including in response to Telegram policy changes.
- We may update these Terms. Material changes take effect on the date shown in the "Version" field; continued use after that date means you accept the new version. For purchases, the version accepted at the time of the purchase governs that purchase.
- You can stop using Synth Cabal at any time by deleting your chat with @SynthCabalBot and, optionally, asking us to delete your data as described in the Privacy Policy.
- We may terminate or suspend your access if you breach these Terms, if required by law, or if Telegram requires it.
11. Disclaimer and liability
To the maximum extent permitted by law:
- the Service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or non-infringement;
- Synth Cabal is not liable for indirect, incidental, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data, or substitute services;
- Synth Cabal's total aggregate liability to you for any claim arising out of or relating to the Service is capped at the greater of USD 100 or the total amounts you paid to Synth Cabal (via Telegram Stars or otherwise) in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law (for example, for fraud or for death or personal injury caused by negligence).
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-laws rules. Disputes that cannot be resolved informally will be submitted to the competent courts of the Republic of Armenia, subject to any mandatory consumer-protection rights you have in your country of residence.
